​Andrew D. Herman is a trusted advisor and skilled litigator with nearly 25 years experience in civil and criminal law in Washington, D.C., and across the country. Andrew counsels corporations, labor unions, political committees, and non-profits on compliance with federal, state, and local rules governing political activity and policy advocacy.

An experienced litigator, Andrew has successfully argued before the United States Supreme Court on behalf of a congressional candidate challenging the constitutionality of an election law provision. He also defended a national non­profit organization in several federal civil jury trials and an appeal involving allegations of public corruption. He has also represented numerous individuals and corporations in complex litigation in federal district and circuit courts involving the enforcement and legality of administrative regulations. He represents individuals subject to federal grand jury investigations relating to allegations of campaign finance and other criminal violations.

Andrew also has experience advising clients on First Amendment issues, voting rights, recounts, ballot access and candidate qualifications. He recently assisted a client in litigating the first voting rights case to be tried in the Northern District of Georgia in over ten years, a case that will continue to influence state policy for years to come.

Elected officials, including members of both the United States Senate and House of Representatives, rely on Andrew's guidance for compliance with federal and state rules governing electoral campaigns and the duties and responsibilities of office holders. Andrew has represented dozens of Members of Congress in ethics investigations and related proceedings.

Andrew also counsels national non-profit and corporate entities on issues involving public procurement and contracting, anti-corruption laws, lobbying disclosure and foreign agent regulations, and government conflict of interest laws.

Andrew has represented numerous clients subject to United States Senate and House inquiries and investigations, including Major League Baseball (MLB) during the United States House Government Reform Committee's investigation into the use of performance-enhancing drugs. He has similarly represented corporations, non-profits, and individuals in high-profile congressional investigations.

  • Represented Major League Baseball (MLB) in the United States House Government Reform Committee investigation into use of performance enhancing drugs. Co-authored extensive legal correspondence addressing the Committee’s inquiry and served as co-counsel for senior MLB officials, including Commissioner Bud Selig, during nationally televised hearings.​

  • Represented congressional candidate in federal lawsuit challenging the constitutionality of election law provision known as the "Millionaires’ Amendment." Following a defeat in district court, appealed and argued case before the United States Supreme Court, winning an opinion validating constitutional arguments and invalidating the statute.

  • ​​Represented the Project on Government Oversight (POGO), a national whistleblower organization, before federal criminal grand jury, during congressional hearings and in two federal civil jury trials. After the second trial resulted in a hung jury, DOJ abandoned its prosecution.
